Definition of Accessory Use

Sullivan Gardner represents the largest international association of haute cuisine restaurants and small inns in a dispute over the legality of office space it occupies in New York City. In a residential zoning district, our client has lawfully occupied office space accessory to an adjacent hotel. The City of New York argues that the use is now illegal as the hotel has closed. Sullivan Gardner seeks to sustain the remaining office use as a pre-existing non-conforming use.
