Extent of Environmental Regulatory Authority
One of the largest asphalt producers in the New York City region is represented by Sullivan Gardner in its negotiation with the New York State Department of Environmental Conservation concerning the spilling of stone into an adjacent waterway. The interesting issue is whether a regulatory agency can go beyond insisting upon compliance to actually dictate operational systems after compliance has been achieved.
