NYSDEC and Aggregates

The largest construction materials firm in the North East has retained Sullivan Gardner to work with the State of New York to cope with the changes in the aggregate materials industry within the context of an anachronistic regulatory structure. The firm is working with the NYS Department of Environmental Conservation to accommodate new materials and modes of transportation. The problem arises out of the fact that regulation by the State is based upon the location of material generation rather than the content of the material. NYC regulation is based upon this latter more effective approach.
