Westchester High School Environmental Prosecutions

Sullivan Gardner is lead counsel in the multiple civil and criminal prosecutions of its client by the State of New York and various towns and school districts concerning the development of the high school athletic fields in Westchester County. The regulation of aggregate materials in the construction industry is a difficult task for environmental regulatory agencies. The statutes and regulations are often contradictory and ineffective. In addition, there is a significant political component to the area of regulation due to the uninformed anxiety of communities concerning what is put in the ground. The firm has been successful in obtaining minimum fines in both the criminal and civil prosecutions.
